Spanish Court Rules free Music Downloads Are Legal for Own Use

A Spanish judge has dealt a blow to the global music industry after ruling that there is nothing illegal about downloading music for free from the internet as long as it is for personal use.

The decision, the first of its kind in Europe, opens the way for Spain’s estimated 16 million internet users to swap music through online sites. "This is extremely unusual," said a spokesman for the international recording industry body IFPI, as the judgment was announced yesterday.

Judge Paz Aldecoa threw out a case against an unnamed 48-year-old man who offered and downloaded digital versions of music on the internet, according to Spanish press reports. He also sent selections of music recorded on CDs out to people in the post, prosecutors claimed.

The judge ruled that, under Spanish law, a person who downloaded music for personal use could not be punished or branded a criminal. "That would imply criminalising socially admitted and widely practised behaviour where the aim is not to gain wealth illegally but to obtain private copies," she said in her judgment.

"If the purpose of the copy is not to gain wealth there is no way that it can be considered illegal," Victor Domngo, head of Spanish internet user’s association Internautas, told the Abc newspaper yesterday. "It would be a lot different if someone downloaded in order to sell on."

But Antonio Guisasola, from Spain’s Promusicae recording industry federation, said the judge had got it wrong. "We have already appealed against the decision," he said. "Peer-to-peer [P2P] sharing is not legal in Spain."

Mr Guisasola, whose federation had backed a prosecution case that demanded a two-year prison sentence and 25,000 (16,700) in fines and compensation, explained it had tried to prove the man was selling the music he sent out on CDs, rather than just distributing it for free.

Even though it had failed to prove that he was selling, Mr Guisasola said his federation was still convinced "private use" was not a legal excuse for downloading music for free. "I have been with both the justice minister and the culture minister today and they are both quite clear that peer to peer is illegal," he said.

This was even more clearly so in a case where music was being shared by more than one person, he said. "People should understand that we all have to respect people who create," justice minister Juan Fernando Lopz Aguilar said yesterday. "These are people who have the right to control the use of their literary or artistic creations in all media."

But the judge insisted Spain’s intellectual property law protected people against being prosecuted if they could prove private use. Spain is drawing up a new law that is likely to strike out the existing right to "private copies" of material.

The licensing of digital content has become a major issue for the entertainment industry. The Financial Times today reported that Google has been offering up to $100m to media companies including CBS, Viacom, Time Warner and News Corp to license their content to the video website YouTube, which it bought last month for $1.65bn. Analysts have warned that YouTube could be targeted by lawsuits for carrying copyrighted material.

Let’s face it, whether it’s the famous Ipod or even the widely popular Playstation Portable (PSP), there are restrictions that need to be understood, and steps that need to be followed properly to transfer songs on to either music platform.

So how do I download music to my Ipod?

Downloading music from your hard-drive to you Ipod is done with the program called Itunes. This program comes with your Ipod purchase or can be downloaded at http://www.apple.com. The software is vital because it not only allows you to purchase from the popular Itunes music service, it’s also the only way you can transfer songs onto your Ipod.

So let’s look into the Itunes software, and more specifically, the Itunes library that is used to transfer songs from your hard-drive to your Ipod. You’ll find it on the left hand panel of the program. Your library contains all your songs, movies, and podcast that you want to transfer over. Through the Itunes library, you’ll be able to use their drag-and-drop feature for easy and fast transfer to your Ipod.

Before we move one to the next step, it should be made clear that songs that are downloaded from P2P clients might not show up on the Itunes library. You must add them manually, because you will not be able to transfer any songs until they are integrated into your Itunes library. Doing this is simple. Click on file>add file to library, locate the file you want to add, and press enter to complete the process. There is also the ‘add folder to library’ function which allows you to transfer a whole folder of songs into the Itunes library. This is quite handy to have if most of your songs are stored in one place on your hard drive.

Alright, let’s get back on track here. You know the proper steps in which to keep your Itunes library updated now, and the last step is a breeze. Plug in your Ipod to the USB port in your computer, and you’ll notice the new option to add songs from your Itunes library to the Ipod. Click and drag your files into the Ipod transfer screen and then you’re done! You’re now ready to explore the wonderful world of music without the burden of a large cumbersome computer to haul alongside you!

Downloading music to your PSP

The common misconception about the PSP is that it’s just to play old Playstation games. It’s not. More and more it’s being used as a great alternative to an MP3 player, and the quality is just as good. There are however some drawback in the PSP that can make downloading music to your player extremely frustrating.

Lets get down to the drawbacks first, and what you need to know to start downloading files onto your PSP. The first is that some file extensions will not work. For example, every song downloaded from the Itunes music service will not work on the PSP because the .m4a extension, which is associated with Itunes, is not compatible with the PSP. Furthermore, if you’re a user of another popular music service such as napster, you’ll find that music downloaded from their service has restrictions placed on their files that will also not work with your PSP.
There are a few options to work around that. The first way to get around this problem is with the use of an audio conversion program. This software will convert a format such as the .m4a extension to an extension that is compatible with your PSP like the .MP3 format.

Currently, the only extensions that work with the PSP are the MP3, AAC, and WMA formats. Before you proceed on, make sure that your files end in the proper extensions!

The next step is to make sure your memory stick, which is where your songs will be stored, is formatted properly. It’s a fairly simple process. Turn on your PSP, go to system settings, and then format your memory stick. A music folder should automatically appear that will be used to place your music in.

From that point, connect your PSP to your computer, via a USB connection. Once that’s done, a new diskette folder should appear in your ‘my computer folder’, in which to drag and drop music files to play on your PSP.

While all of us enjoy music, we may not have an idea of the basic requirements of the computer, or the software to enhance that listening experience. This is a beginner’s guide to break free from the shackles of ignorance and using the PC as the ultimate music partner.

Music software has undergone a rapid transformation over the past few years. A wide variety of software is available in music and hardware stores, as well as over the internet. Numerous websites allow you to download music, often giving away free music software to make themselves popular. To successfully make the best use of the facility, we need to familiarize ourselves with a few basic requirements. Let us examine these requirements for a successful music download.

First and foremost let us look at the hardware requirements. Apparently, a PC or a laptop is the primary requisite. Coming to the Software. If you have a Windows based system, anything that is Windows 98 upwards will do just fine. Red Hat Linux also supports music downloads. If you have a Mac, well- you need look no further.

If, however, you are planning something more advanced like studio recording etc, go in for higher end music production software that has sound editing and audio ripping capabilities.
